Key Takeaways
This post is a 4 minute read.
A Lake Martin dock sits on land Alabama Power controls, so it needs a permit of its own.
Alabama Power's guidelines say a permit is non-transferable without written consent.
Sellers are asked to notify Alabama Power of the new owner at least seven days before closing.
A dock is not a separate loan. It rides along with the home purchase or a renovation loan.
Ask for the permit paperwork before you write the offer, not after.
Most buyers ask what the dock is worth. The better question is whether the dock is legal. On Lake Martin, a boathouse that looks perfect at the showing can still carry a permit problem. That problem can follow you to closing. Here is what to check, and how a mortgage fits around a dock.
Who Actually Controls the Shoreline
Lake Martin covers about 41,150 acres and has roughly 880 miles of shoreline. Alabama Power manages the lake under a federal license. That includes the strip of land right at the water. Its published guidelines require a written permit before shoreline work begins. Verbal approval does not count.
Alabama Power also keeps what it calls a 30-foot Control Strip on part of the shoreline. Work in the lakebed, the flood easement, or that strip can need a permit. Between mid-2017 and the end of 2022, the company reported 4,167 permits on Lake Martin. About one third were on property with that control strip.
What the Rules Say About Size
The guidelines we reviewed cap total structure space at 1,510 square feet. A stationary pier can run 50 feet. Other structures can reach 62 feet. Everything must sit at least 15 feet inside the extension of your side property lines.
One caution. Those guidelines carry a May 2017 date, and Alabama Power is updating its Lake Martin plan. Treat these numbers as a starting point. Confirm the current rules with Alabama Power before you rely on them.
The Permit Is a License, Not Property
This surprises people. Alabama Power describes the permit as a license to use the shoreline. It does not create ownership or an easement. Older structures may qualify as legacy structures and keep permits without a fee. If a storm destroys one, the replacement usually has to meet current standards.
That matters for value. A grandfathered boathouse may not be rebuildable at the same size. Ask your agent what would happen if it were lost.
Permits Do Not Move Automatically
Alabama Power's guidelines call the standard permit non-transferable without its written consent. The owner is asked to send the new owner's name and address at least seven days before the transfer. Skip that step and the permit can be terminated.
So put it on the timeline. Ask the seller to start the transfer notice as soon as you are under contract. Also ask for a copy of the permit and the approved drawing. A pier that was added later without a permit is the seller's problem today. After closing it becomes yours.
How a Dock Fits Into Your Loan
A dock is not financed by itself on a home loan. It is either already built and part of the purchase, or a repair you pay for separately.
If it already exists, the appraiser decides what it adds, if anything. Some lenders and appraisers give a dock little weight. Do not count on the dock to close a gap in the appraised value.
If it needs work, a renovation loan may be an option. Some renovation programs allow docks and seawalls, once permits and any association approvals are in place. The cost is folded into one closing. Eligibility depends on the property and the program. Our guide to renovation loans in Alabama explains how those work.
Lake Martin Homes Also Need Flood and Water Checks
Waterfront homes bring extra homework. Ask whether the home sits in a flood zone. Ask about insurance costs before you fall in love with the view. Look at the bank too. Alabama Power says riprap and natural stabilization are its preferred methods, and seawalls are reviewed case by case. A failing seawall can cost real money.

A Short Dock Checklist for Your Offer
Before you sign, ask for these items. Ask for the Alabama Power permit and the approved drawing. Ask for any subdivision or association approval. Ask whether the structure is a legacy structure. Ask when the seawall was last inspected. Then build time into the contract to sort out any gaps. A good agent and a good lender can help you sequence all of it.
Frequently Asked Questions
Do I need a permit to build a dock on Lake Martin?
Yes. Alabama Power's guidelines require a written permit before shoreline construction. The permit request form alone does not grant one.
Does the dock permit transfer when I buy the house?
Not automatically. Alabama Power's guidelines call it non-transferable without written consent. The seller is asked to notify the company at least seven days before the transfer.
Will a lender add the value of a dock to the appraisal?
It depends on the appraiser and the market. Some docks add value and some add very little. Ask your loan officer how the dock may be treated.
Can I finance a new dock or seawall with my home loan?
Sometimes. Certain renovation loans can cover docks and seawalls when permits are in place. Eligibility varies by program and property.
What if the dock was built without a permit?
That is a risk to raise before closing. Talk with your agent, a real estate attorney, and Alabama Power about how to resolve it.
Can a legacy boathouse be rebuilt the same way?
Not always. Alabama Power's guidelines say replacements of destroyed legacy structures must meet current standards.
